USCIS Introduces H-1B Program Changes in 2024

By KPB Immigration Law Firm

February 29, 2024

In late January, the U.S. Citizenship and Immigration Services (USCIS) rolled out new measures aimed at bolstering the H-1B visa program and curbing fraudulent practices. These changes encompass updates to the H-1B registration process, online filing options for H-1B forms, and fee adjustments.

Ur M. Jaddou, Director of USCIS, expressed optimism that these changes will foster a fairer selection process for H-1B petitioners and beneficiaries.

Understanding the H-1B Visa

The H-1B Visa is a vital pathway for skilled foreign workers hired by U.S. companies to perform specialized roles. Eligibility criteria for the H-1B visa include:

  • Holding a Bachelor’s degree or higher in the relevant field
  • Meeting the minimum educational requirements for the position
  • Demonstrating the requisite educational attainment to undertake specialized work

To ascertain your eligibility for the H-1B Visa, consult with an immigration lawyer at KPB Immigration Law Firm.

H-1B Registration Final Rule

To enhance integrity in the H-1B registration process, the selection methodology will transition towards a more equitable and beneficiary-centric approach. This shift ensures that each beneficiary has an equal chance of being selected, regardless of registration volume. Starting in 2025, a passport or valid travel document will be mandatory for H-1B lottery registration.

H-1B Fee Adjustments

Significant fee adjustments have been implemented for H-1B visa applications:

  • H-1B petition fees will rise from $460 to $780.
  • H-1B registration fees will increase from $10 to $215.
  • Both fee adjustments are slated to take effect on April 1, 2024.

Moreover, premium processing fees for Form I-907 filings have been raised from $2,500 to $2,805 as of February 26, 2024.
